1. These Terms and Conditions apply if you enter Match Score ("the Game") located at (www.matchscore.xyz) ("the Website") and/or the Match Score application (“Application”) that is operated by Sports Capital International Sdn. Bhd. collectively ("the Game Provider" and “Application Provider”). You are bound to play within the terms and conditions of play as specified.

2. The Website and the Game are hosted, managed and operated by Sports Capital International in partnership with Plan B Eleven Company Limited. Any reference to “you”, “your”, or the “Player” means you as user of the services on the Website, and any reference to “we”, “us”, “our” is to the Game / Application Provider.

3. Informative and explanatory information relating to Match Score, including the Scoring System, game Rules and Privacy Policy, form part of these Terms and Conditions.

4. We strongly recommend that you read these Terms and Conditions together with the Scoring System, game Rules and Privacy Policy carefully before entering the Game.

5. By submitting your details on the Website and/or the Application and/or accessing and continuing to use the services related to playing the Game (the “Service(s)”) available online, you agree that you have read and you accept these Terms and Conditions. If you do not agree with these Terms and Conditions then you should not use and/or continue to use the Service(s) on our Website and/or the application.

6. Please note that we may update and amend these Terms and Conditions from time to time and any changes will be posted on the Website. It is your responsibility to familiarise yourself with any changes. We recommend that you print and store or save a copy of these Terms and Conditions for future reference.

7. Services such as games and/or the Application offered by www.matchscore.xyz may vary in terms of looks, performance, stability and dimensions depending on individuals' browser capability. The website (www.matchscore.xyz) will not be held responsible for any device compatibility issues faced by participants/players.

8. If www.matchscore.xyz and/or the Application is not capable of running as planned due to any reason (including, but not limited to fraud, a state of emergency, natural disaster, war, technical failures/glitches or any other causes), the Game / Application Provider reserves the right to cancel, modify, terminate or suspend www.matchscore.xyz services.

9. Scope of License: This license granted to You for the Licensed Game / Application by Game / Application Provider is limited to a non-transferable license to use the Licensed Game / Application on mobile devices that You own or control.

10. This license does not allow You to use the Licensed Game / Application on any mobile devices that You do not own or control, and You may not distribute or make the Licensed Game / Application available over a network where it could be used by multiple devices at the same time.

11. You may not rent, lease, lend, sell, redistribute or sublicense the Game / Licensed Application. You may not copy (except as expressly permitted by this license and the Usage Rules), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open sourced components included with the Licensed Game / Application).

12. Any attempt to do so is a violation of the rights of the Game / Application Provider and its licensors. If You breach this restriction, You may be subject to prosecution and damages.

13. The terms of the license will govern any upgrades provided by the Game / Application Provider that replace and/or supplement the original Product, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.

14. You agree that the Game / Application Provider may collect and use technical data and related information, including but not limited to technical information about Your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to You (if any) related to the Licensed Game / Application.

15. The Game / Application Provider may use this information, as long as it is in a form that does not personally identify You, to improve its products or to provide services or technologies to You.

16. By entering the Game you acknowledge that the Game / Application Provider will hold and use your personal data for the purpose of administering the Game, and you acknowledge that we may pass your personal data to relevant parties for the purpose of fulfilling the prize should you become a winner.

17. Plan B Eleven Company Limited and/or the sponsors of the Game may contact you from time to time for the purpose of sending marketing information where you have given your consent to receive such marketing information from Plan B Eleven Company Limited and/or the sponsors of the Game.

18. Your personal data will be used in accordance with the Privacy Policy.

19. Your personal data may be passed to relevant regulatory bodies, the police or other authorities in the course of the investigation of any complaints or suspected unlawful activity.

20. Aggregate, non-personal data may also be used for the purpose of undertaking market research or in facilitating reviews, developments and improvements to relevant services.

21. The license is effective until terminated by You or Application Provider. Your rights under this license will terminate automatically without notice from the Game / Application Provider if You fail to comply with any term(s) of this license.

22. Upon termination of the license, You shall cease all use of the Licensed Game / Application, and destroy all copies, full or partial, of the Licensed Game / Application.

23. The Game is open to subscribers residing in Thailand and above the age of 18.

24. Only subscribers residing in Thailand are eligible to claim any prizes arising from their winning participation in the Game.

25. Subscribers must have played (entered the scores) for at half (50%) of the listed Game Weeks to be eligible to claim the grand prize.

26. Employees of Plan B Eleven Company Limited and Sports Capital International Sdn Bhd, their relatives and any of their affiliates, agencies or persons professionally associated with the Game, are not eligible to win any prizes associated with the Game.

27. Each entrant may only enter the game once, and may not control more than one account. No entrant is allowed to control more than one account, or enter more than one set of entries for any round of matches.

28. If an entrant is found to be operating more than one account, only the first account created will be eligible for prizes. Any additional accounts will not be eligible for prizes, and may be removed from the game entirely.

29. You must follow the instructions on the Website and/or the Application by registering your details and confirm your acceptance of these Terms and Conditions. You may then make your entries as described on the Website and/or the Application or return to the Website and/or the Application at a later time to make your entries. Our computer record of your entry into the Game will be considered to be your entry.

30. The Game / Application Provider reserve the right to reject your entry if they consider in their sole discretion that your entry in whole or in part:

(a) is against the spirit of the Game or good sporting conduct, or

(b) does not comply with the Rules of the Game including these Terms and Conditions.

31. The decision of the Game / Application Provider is final.

32. The Game is open for entries where indicated on the Website and/or the Application and you may play the Game on the Website and/or the Application during the dates and times indicated on the Website and/or the Application.

33. The deadline for submission of any individual entry is the scheduled kick-off time of the match being entered. Please note that scheduled kick-off time refers to the pre-published kick-off time of the match in question. If delays or other events cause a fixture to start later than the scheduled kick-off time, the entry deadline will remain as the scheduled kick-off time. For example, if a match scheduled to kick-off at 15:00 actually kicks off at 15:10, an entry will still need to have been made by 15:00 for the entry to be taken into account for scoring purposes.

34. You can change your entries for each match as many times as you like until the scheduled kick-off time of the match.

35. The Scoring System is based on the calculations below:

(a) For correctly entering the outcome of a game (e.g. Team A to beat Team B) you will score one (1) point.

(b) For correctly entering the final score in a game (e.g. Team A to beat team B 3-1) you will score three (3) bonus points.

(c) For wrongly entering the final score in a game, two points will be deducted from your total points for the Stage.

(d) For entering a match entry for every Stage, you will score a point.

36. The Game / Application Provider reserve the right to introduce incentives in the form of additional points to enhance game playing.

37. The prizes awarded in respect of the Game ('Prizes') will be at the discretion of Plan B Eleven Company Limited. Plan B Eleven Company Limited reserves the right to alter and amend the Prizes where circumstances beyond its reasonable control require it to do so.

38. The winner will be determined as the Player with the highest number of points amongst all eligible entries. In the event of a tie for any of the prizes, the winner will be determined by:

• the time which they confirmed their scores, with the Player that confirmed his/her scores earliest being deemed the winner.

• the frequency of matches for correct scores, with the Player that accumulated the highest scores deemed the winner .

• the time at which they initially registered for the competition, with the Player that registered earliest being deemed the winner.

39. Plan B Eleven Company Limited will contact each winner as soon as practicable on or after the end of the month containing the applicable Game Week. Each winner will be contacted on the phone number or email they provided when registering to enter the Game.

40. Reasonable efforts will be made to contact a winner by phone and by email. If they cannot be contacted or fail to provide an address for delivery or fail to meet the eligibility requirements as set out in these Terms and Conditions this may result in forfeiture of the prize.

41. Plan B Eleven Company Limited reserves the right to offer the prize to the Entrant who accumulated the next highest points in the Game from amongst all eligible entries into the Game and thereafter until a winner is found.

42. Plan B Eleven Company Limited will endeavour to ensure the prize is delivered to the relevant winner’s home address as indicated in their registered details on the Website, within 28 days of the confirmation of the winner, i.e. the date when the relevant winner has been successfully contacted and received confirmation of eligibility, and compliance with all applicable terms and conditions.

43. Plan B Eleven Company Limited’s decision in relation to the award of prizes and all other matters associated with the Game will be final and no correspondence will be entered into.

44. The Game / Application Provider and any third party nominated by the Provider including without limitation the game sponsor) may exercise its sole discretion to use an Entrant’s name, image and/or their comments relating to the Game and the prize for future promotional, marketing and publicity purposes in any media worldwide without notice or without any fee being paid.

45. For the avoidance of doubt, any winner may be required to participate in any marketing and/or publicity at the Game / Application Provider’s discretion. The winners’ names may be published on the Website and Application.

46. The Game and the Website and/or Application are provided on an “as is” and “as available” basis. The Website and/or Application and the Game may not be available at all times and may not be free from errors or omissions.

47. The Game / Application Provider will not be held liable where the Game and/or the Website is unavailable at any time due to reasons beyond their reasonable control, including but not limited to strike, lock-out, labour dispute, illness, act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with a law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation.

48. The Game / Application Provider and their associated affiliated and subsidiary companies accept liability for technical, hardware or software failures of any kind or for lost entries or unavailable network conditions which may limit or prohibit the opportunity to participate in the Game or where the Game, the Website and/or Application is discontinued, modified or changed in any way.

49. All intellectual property rights in the Game, the Website and/or Application Provider (excluding content which you submit) shall remain at all times the property of the Game / Application Provider or the Game / Application Provider’s licensors.

50. Nothing contained in these Terms and Conditions shall be construed as conferring by implication any right to use any trademark, patent, design right or copyright of the Game / Application Provider or of any third party.

51. The intellectual property rights in the rules and point-scoring structure belong exclusively to Sports Capital International Sdn. Bhd. and it may not be reproduced in any format without prior written consent from the Sports Capital International Sdn. Bhd. Match Score is a registered trademark and cannot be used without Sports Capital International Sdn. Bhd.’s express permission.

52. The Game / Application Provider take no responsibility whatsoever for content that may be published on a Private League bulletin board on the Website.

53. By submitting content to the Website, you grant us a perpetual, non-exclusive, royalty-free and transferable license (with the right to sub-license) to use, edit, copy, distribute and make available to the other users of the Website and in any other formats or media as we decide. You agree to waive your moral rights.

54. You agree not to publish any material or content which is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or infringes the rights of a third party or which may have the effect of being harassing, threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability. You agree not to infringe any laws in order to publish such content.

55. You agree not to transfer files that contain viruses or other harmful programs. Publishing any such content or material may result in the content or material being removed and your disqualification from the Game.

56. The Game / Application Provider will make all reasonable efforts to ensure the accuracy of the Game information on the Website and/or Application to update such information on a regular basis, but does not guarantee that such information will be accurate or up-to-date at all times.

57. The Game / Application Provider reserves the right to disqualify any entry, or vary, amend or waive these Terms and Conditions at any time and the Entrant agree that no liability will attach to the Game / Application Provider as a result and that the exercise of such discretion will not result in any compensation being payable or paid to any Entrant. It is a condition of entry that all rules are accepted as final and that the Entrant agrees to abide by such rules.

58. Any user of the Website, and/or Application and/or Entrant found to be attempting or suspected of attempting to hack into any servers, systems or software operated by the Game / Application Provider will be immediately removed from the system. The Game / Application Provider reserve the right to report the matter to the relevant authorities.

59. The Game / Application Provider reserve the right to investigate any complaints that they receive but will be under no obligation to do so. Should the Game / Application Provider choose to exercise this right, their decision will be final and binding on all complainants and the Game / Application Provider will not enter into any correspondence regarding their decision or any other matter.

60. Nothing in these Terms and Conditions restricts your statutory rights as a consumer. Nothing in these Terms and Conditions shall exclude or limit the liability of the Game / Application Provider for death or personal injury caused by their staff or supplier’s negligence or for fraud.
